U.S. Freelancer Tax: 1099-NEC, Sales Tax Nexus, and What Hisabi Tracks

If you freelance in the United States, you live in a federal-and-state tax world. 1099-NEC reporting from clients, state-by-state sales tax nexus, and quarterly estimated tax. Here's the SME-friendly walkthrough and how Hisabi fits in.

U.S. Freelancer Tax: 1099-NEC, Sales Tax Nexus, and What Hisabi Tracks

The United States doesn't have a federal VAT. Instead, freelancers and small businesses live in a layered world: federal income tax (with self-employment tax for sole proprietors and single-member LLCs), state income tax in 41 states plus D.C., and state-and-local sales tax in 45 states plus D.C., each with its own nexus rules and rates.

This guide focuses on the two compliance pieces that bite freelancers the hardest: Form 1099-NEC and sales-tax nexus.

Form 1099-NEC: what your clients send the IRS

If a U.S. business pays you $600 or more for services in a calendar year, they must issue you a Form 1099-NEC by 31 January of the following year. They also send a copy to the IRS. The IRS expects to see those 1099 totals on your Schedule C.

Mismatches trigger CP2000 letters. Keep your invoice ledger and your 1099s reconciled monthly — Hisabi's revenue report by client makes this a 5-minute job at year end.

  • Provide your clients with a completed Form W-9 (sole prop) or W-9 + EIN (LLC) the moment you onboard them.
  • Track invoices paid by calendar year, not fiscal year.
  • Reconcile every 1099-NEC you receive in January against your Hisabi paid-invoices report for the prior year.
  • If a client pays you via Stripe, PayPal or any third-party payment network, they may issue Form 1099-K instead — don't double-count.

Sales-tax nexus: when freelance services trigger sales tax

Most U.S. freelance services (consulting, design, writing) are not subject to sales tax. But — and it's a big but — some states tax certain services and most states tax digital products, SaaS subscriptions and tangible personal property.

Since the 2018 Wayfair decision, every state has economic nexus thresholds. Cross the threshold (often $100,000 in sales or 200 transactions per year, lower in some states) and you must register, collect and remit sales tax in that state. Marketplace facilitator laws shift the obligation to platforms in some cases.

Quarterly estimated tax

If you owe more than $1,000 in federal tax for the year, the IRS expects four quarterly payments (April 15, June 15, September 15, January 15 of the following year). Self-employment tax is 15.3% (Social Security + Medicare) on top of income tax. Plan for it.

What this means for U.S. freelancers

  • Send polished, paid-on-time invoices via Hisabi — every payment-date is a 1099-NEC and Schedule C data point.
  • Configure sales tax per state where you have nexus — Hisabi supports state-level tax labels and rates.
  • Use Hisabi reports to estimate quarterly tax; export to your CPA in CSV.
  • Keep your business records 3 years for federal tax (longer if income is omitted or fraud is suspected).

How Hisabi helps

Hisabi handles U.S. invoicing in USD, lets you set per-state sales-tax rates, and gives you a clean revenue-by-client report for 1099 reconciliation. Stripe Tax integration covers the messy state-by-state nexus calculation when your subscription business sells across U.S. states.

When you've been paid $600 or more for services during the calendar year. They issue it by 31 January of the following year.

Most professional services are not taxable in most U.S. states, but digital products, SaaS, and some service categories are taxable in some states. Check the rules in any state where you have economic nexus.

Economic nexus is the rule (since the 2018 Wayfair decision) that a state can require an out-of-state seller to collect sales tax once they cross a sales or transaction threshold — commonly $100,000 in sales or 200 transactions per year.

At least 3 years for federal tax under IRC § 6501. Extend to 6 years if you may have omitted more than 25% of gross income, and indefinitely in fraud cases.
